Subsistence violations dismissed for Kookesh and 3 others

According to CoastAlaska (via KRBD-FM, Ketchikan), a court has dismissed overharvest charges against state Senator Albert Kookesh (D-District C) and three co-defendants. The case alleged that Kookesh and the other men caught salmon in excess of their subsistence allotment. The court's formal decision is not yet complete, but Superior Court Judge David George seems to have agreed with the defense that the bag limits placed on that particular fishery were too low (15 fish per family per year) and more importantly, that the limits were not devised in accordance with the Administrative Procedures Act. So the four fishermen are in the clear -- except for a single charge of fishing without a subsistence license. That charge couldn't be commented upon, but was last set for trial on Sept. 8.
